Hey neighbors...does anyone have any information on KB packing up and leaving?  I see that they've pretty much dismantled the models and fencing and had heard they had a furniture sale already.

Rumor has it that Phase II is on indefinite hold, but hopefully KB will continue paying the HOA for the 300-some-odd lots that haven't been sold yet.  Somebody's got to pick up the tab for the superchlorination in our poop...i mean pooL.

I was wondering the same thing when I drove by yesterday. I heard that they had another model furniture sale a couple of weeks ago. It was kinda fishy though, at least I thought, since it was on a Friday and between the hours of 7:00am - 10:00am. Maybe I'm wrong but don't people work at those hours?? Seems like they just wanted to quietly disappear. I am going to have to send my hubby over there to find out.

How did you guys know about the furniture sale? We used to get emails, but they stopped coming a looooong time ago. Is the office still there? They better be...KB owes us a chunk of change.

I was told by my good friend who has friends on the inside. They gave her the information and she told me about it. Last time they put up fliers on the mailboxes.

so are all the models cleaned out?? There is a coffee table in one of them that I would love to buy And an area rug, too....for some reason everytime something is put on our mailboxes it is gone within a day. When my cat ran away we put up postings on all of the mailboxes at night and they were literally all gone by morning.

I would guess that your lost cat sign was a victim of your neighborhood vigilante enforcing the law of not putting flyers on the mailboxes.  This person, much like the vigilante known as The Batman, has a secret identity.  In their mild manner guise as friendly neighbor, they will look you straight in the eye and smile while they have your crumpled up lost kitty posters in their pocket, a copy of the CC&R's under one arm and clipboard in hand secretly making notes of landscape and parking violations.

That is funny Nawor. While it is true what you say (just show yourself HOA VIGILANTE), its sad that there are people like that. I think our neighborhood needs a lot more work but a majority of the homeowners take care of their yards. There are a few things i would be a NAZI about (like cigarette butts littered all over the sidewalk and rocks, dog poo, parking on sidewalks) but I like the fliers. That seems to be the only way for the WHOLE neighborhood to know what is going on. I agree they should only be left up for 48 hours and no longer. I say we all get together and start our own HOA!!!!

I agree we should start our own HOA!!! I dont think we should litter the neighborhoods with signs, but I think lost pet/stolen property signs are okay in moderation....

My hubby went down to the office and asked if they're leaving and they said they are staying until the last lot is sold....now, I don't necessarily believe everything they say...but that's the word they're giving!

Well I heard a Rumor just today. I heard that KB is packing up and selling the rest of their land back to the bank cause they can not afford to keep it. I was told that it was in this month paper....... I will have to see. Just letting everyone know what is up!

I was driving by the biggest model home and there was a huge U haul either loading or un-loading stuff...it looked like loading. I thought it was odd so they are either packing up or someone is moving in??? It was at 9PM at night too... Have the model homes been sold?

I don't know if they've been sold, but they're all emptied out. We walked by there tonight and I peeked in the windows....all cleaned out (not yet repainted, but no furniture). That kinda sucks because there was a coffee table and area rug I would have loved to buy! I personally think they're packing up and hittin' the road. What the heck are they going to do with the rest of the empty lots in Sage and Juniper?? Are those just going to be a breeding ground for weeds, bugs, and other critters forever???

I know that they are up for sale. The first watercrest model (the one story was sold and there is someone living there).

If KB sells off Phase II, won't that turn the HOA over to the community (i.e. homeowners)?  If so, how are 350 lots going to pay for the cost maintenance and upkeep of community amenities that was originally intended to be split by 700 lots?

It may be time to re-enter into negotiations with the Town to have them buy our common space/pool area.  I'm not a fan of this at all, but can't fathom our HOA doubling  to make up for the loss of the Phase II HOA dues.

Any lawyers out there know if we can make KB continue to pay the balance of the HOA in the interim?

If they end up trying to make us (the 350 lots) pay for the HOA fees/pool/land upkeep all on our own we'll be screwed. We can barely pay for the HOA as it is with how bad things are for us. The thought of paying nearly $200/mo because KB backs out of the rest of the community would kill us.

A lot of the lots that are left are in the red zone. How can they make us pay for lots that would just sit there and grow weeds? The lots that are bare now haven't been picked up or cleaned. Take about a breeding ground for scorpions, snakes and lord nows what other desert creatures. I would really fight that!! Plus I heard they were only selling the model homes becuase it cost 80K for upkeep and they were just trying to cut their costs. They have spec homes, in their respective communities, to use as models.

I looked at purchasing a KB home in your area a few years ago but was hesitant because they were the only builder in the development and I was concerned KB would pull out. I did some research about HOA fees and found out that even if the builder pulls out they still have to pay the HOA fees for the empty lots. If KB would file for bankruptcy protection then the homeowners would have to pick up the cost for the remaining lots.

Also, if KB sells the land, the new owners would be responsible for the HOA fees. I am not a lawyer but this is the information I found in my research from a few years back.

Since Desert Passage is a relatively small community I would be more concerned about the number of vacant homes and foreclosers. HOA fees most likely are not being paid on homes that are in the process of foreclosure. This could impact the HOA budget and cause HOA dues to increase.

sounds like the same thing that happened to us over in elite at tortosa....they had a trailer parked in front of their models...and cleaned them out...this was either right before or right after they filed for bankruptcy....sounds like kb is pulling the same on you guys
