My guess is this is a well charted topic. However, I thought I would bring it up again because we just had our HOA fees go up and sure enough there is the Orbital fee. Personally, we use Direct TV and have nothing to do with Orbital. We don’t mind helping my neighbors, but we do feel that this is an unfair CCR because not everyone in the neighborhood uses Orbital. Any information on how to try and get this charge gone is appreciated. <img src='http://www.85239.com/desktopmodules/ntforums/images/emoticons/smile.gif' height='20' width='20' border='0' title='Smile' align='absmiddle'>

We feel the same way. When we moved in, my husband called the HOA trying to dispute this charge and have it removed since we use Directv as well. No luck. It is a little upsetting to have to pay a fee for something we don't use. (and personally I don't think a lot of people here in CF use it as well...I see Directv dishes on MANY houses in our neighborhood!)

Acacia Crossings has a 30 year agreement with Orbitel. Can you say monopoly? The fee is in our HOA fees and the agreement was made when Shea was in charge of the HOA a long time ago.......

'Many' moons ago when developers started building no big cable company would come out here. Orbitel said they would under one condition, yep you guessed it, the 30 year contracts. Signing the papers when you purchased your home also included one for the Orbitel contract. AC has looked into what it would take to get out of the contract, a lot of money that's what.

I personally do not use Orbitel either, but I knew that when I bought my home and signed the paper saying I would be paying Orbitel money for the next 30 years.

Java Lover is right. Orbitel was the only company willing to take a "risk" on Maricopa a few years back. At the time everyone was thankful that someone would come out here. The joys of growing pains. It was disclosed to us when we were buying a house and explained why the contract was the way it was. We don't use it either, but I am glad that there was at least one cable company willing to come out here at the time :o)

The worst thing about these contracts is that the fee is monthly per house, regardless of whether the houses are unoccupied. That means that you and I are picking up the tab for all the houses Investors bought and walked away from after their greed caused the market to crash. Oh well, life never has been very fair!

Another view on this is, also, that homeowners that are way behind in their HOA dues are getting free Basic Cable, the tab being picked up by the homeowners that DO pay their dues. Also, if a lot of the houses are unoccupied, (like those that have been foreclosed on, or are for sale), does the HOA pay Orbitel for the empty houses? Maybe the contract with Orbitel should be renegotiated to state that only occupied houses should pay for Basic Cable, since it is NOT fair for the rest of us to be paying for empty houses with cable, since, when we move into a house, the cable is turned OFF, and we have to call the Cable company to have it turned on.

Further, if a developer is going to build, say, 500 to 700 houses, (or whatever the number of houses), when does Orbitel start getting paid?
Does the HOA or the developer start paying to Orbitel for one house at a time as the houses are being sold, or do they pay for 500 to 700 houses (or whatever the total number of houses is) all at once?

we all pay for orbitel in our HOA fees, regardless of our usage of it.

Just for the record ALL lots pay the HOA fee for Orbital, Fulton (the unsold), investors, landlords and owners that live in the home. Orbital hooks up basic cable when an owner calls but gets paid for all lots for 30 years starting in 2002. They, Orbital, must pay back the bonds they sold to get the money to lay the cable and infrastructure in Cobblestone farms. You should have it connected even if you use a dish, you can have both

To be fair, this is a fee for the infrastructure for Orbitel's cable system. Cable infrastructure is very expensive, and since every house has the infrastructure every house can and should have fees collected. You'd be paying for it one way or the other.
