We can all start to assume where some of these "nonresponsive, bad habit, irresponsible, etc" homeowners come from. We have a new Board now and I'm going to see by the end of this year if improvements has been made. I certainly hope changes will come, the economy is bad, we live in a rural community, and these homeowners are not helping with our property value.

I want us to opt out of the Orbitel contract when the time comes and put that money to good use (3 MORE YEARS!!!! I hope I can survive)

Mu hot tub is not working too well, I like iheir hot tub for parts.     Glad  am not the only one up set by the tub. They have not read the HOA news letter about trash bins either. Maybe they are planning a block party and will fill it with Uncle Jack...Jose  or Auntie Gin . We bring our won straws...

Hey Graham,

It appears to be a lot of common areas that are inside the community, besides the parks and side of the main roads.  Near us in the small Pulte's in phase 3, there are 2 common areas.  Both on Toya, one near the mailboxes, and the other is near the corner of Toya and Martie Lynn.  It is the stretch of plain rock next to corner lots.  I could provide picturs of how the HOA's landscapers aren't taking care of it, but we pull the weeds weekly so we don't have to see the weeds.

The section in the Wildflower series is pretty bad, like what was mentioned, I believe its on Toya as well.  Not only is it over grown with weeds, but it was never rocked.  According to Pulte, this is an HOA issue.

I saw a bank owned home being cleaned up this morning by some guy? So either it was a very nice neighbor or the bank does send people to clean up their properties.

The landscape company for Pulte does rock the side yards for the corner houses. On the other hand, the DR Horton landscaper rocked the side yards in phase 1 and phase 2 but for some reason isn't doing it in phase 3?? I think DR Horton needs to contact their landscaping company and find out if the landscaper is responsible for rocking that side yard or if it was not in the bid.

I don't think the HOA has budgeted for rocking DR Horton's side yards in phase 3.

When the community started, the HOA was not aware that they would have to maintain the side yards of all corner houses. The homeowner was responsible for the side yard maintenance until the builders informed the HOA that they would have to maintain all side yards since it is considered a common area and not the property of the homeowner. This all happened in phase 1 and the landscape company for the HOA should know about maintaining side yards in all phases..

So what constitutes "cleaning up" the weeds? If the yard is covered in small weeds after the big ones are clear...that is still a violation is it not? This should be a zero tolerance policy IMO.

Question for you.....once all the notices are sent, the yard is cleaned by the landscaper for a fee and a lien is placed and the house is sold for LESS than is owed......which is happening more and more,..... how does our HOA collect our lost money?

You and I both know that isn't exactly true. We follow the law, and we sue them in small claims court. If we win in small claims court we can attempt to collect the money. If that doesn't work, in theory, we could attempt to garnish wages. But, none of our cases have made it that far yet.

While I see the point Jesse and Tio are making (that we are throwing that money away), and agree with them, there are legal steps that we take to try to recoup the losses.

Its a great start. I hope this is a turning point for this community. I love living here and think it can get so much better with a little work on those who don't like to comply to the rules.

It is a good step in the right direction. Out of the 80 some 14 day letters that were sent out, about 20 of the residents got their front yards cleaned up. Hopefully the landscaping company that cleans up the 66 homes will put down pre-emergent so we won't see weeds in those front yards for months to come.

We as residents need to keep reporting violations to Kriss if we want to make progress. The quicker we can get a weed violation reported, the quicker we are to the 14 letter and then an eventual clean up.

I have seen quite a few people out this morning picking weeds! It only takes a $750 fine to motivate people.

Well I bet you didn't see anybody picking weeds in the first house past the Pulte Model homes. That place has really got to help sales for Senita. Plus the half chair sitting by the front door..... nice......
