Alert | I emailed Barbara and received and auto response that she is out of the office. So I emailed her assistant and have not received a reply.
This is ridiculous. I still have not received my ballot.
If anyone would like I am willing to gather your ballots and take them to the meeting. I would request that you put your completed ballot in a sealed envelope and sign the across the sealed flap. PM me if you would like to me pick up.
If we do not get a quorum (74) homes by ballot or proxy (hey do they have a proxy form in the ballot?) we will have to reschedule. $$$

Java, if you get on the board, I hope you can sort out a lot of the communication problems! I seriously wish you luck!</div>
We will see, I'm not getting my hopes up but I will go in kick butt and take names! ;o)

Thank you very much for your offer to take the ballots in...I just sent mine off so I hope it gets there in time! I imagine these late ballots were a widespread problem so we'll have to see if you get the quorum.
Incidentally, I did not have a proxy form along with my ballot.

Alert | | GilaGuy, did you notice that the ballots were to be returned and received by the HOA by October 22nd in order to be counted? According to that, if you mailed it back to them after the 22nd, it wouldn't be counted. I wonder how many people don't have access to this website, and haven't received any ballots, or even know about the deadline for returning the ballots. This whold mess is one major screw-up, and we don't even have a George Bush around here to blame it on.

Java, I'm going to PM you. Thank you for doing this!
The HOA President has posted this on the HOA board in case anyone missed it:
"Oct. 27th and 28th, Board members and other volunteers will be out across the community handing out ballots. If you can't make the meeting on the 29th, please fill out the ballot, put your name and address at the top and sign the ballot at the bottom. Due to the problems in the mailing process, we all need to make sure we get our quorum for the meeting. Many of you are not happy about this situation, neither is the Board. We will start an investigation into the mailing process next week."

haha, yes I did notice that...my other half can attest to that, as she bore full witness to my rantings and ravings about it. ;-)
This whole thing is insane, as far as I am concerned. We can't be the only two who received the ballots too late to be counted, right?

Alert | | The HOA, also known as Roger Wittal, stated in the HOA website (and it was also posted in 85239.com), that he and members of the board and other volunteers would be out in the Acacia Crossings community passing out and collecting ballots on October 27 and 28. It is now 4:12 PM on the 27th, and I have been up and down and across the streets of Acacia Crossings several times today, and there was no sign of anyone, ANYWHERE, either passing out ballots, or collecting filled out ballots for the meeting on the 29th. It seems there is more "hot air" in Acacia Crossings than there is in the rest of Arizona in the summertime, combined. I was never contacted to be a volunteer, and he and Barbara Simser will not answer emails, or their telephones (or cell phones), so what assumptions are we supposed to make? Will they and other members of the board be out tomorrow, on the 28TH, passing out and collecting ballots? WE WILL SEE!!!!!!!!!!!!!

Alert | Bob, I completely understand your frustration. No one that I know has a ballot, so that is part of the issue. Right now another homeowner is making copies and will get them to others later this evening. As soon as I get my copies I will be out there. If you would like to help let me know and I will make sure you get some too.
As for those volunteering, no one called or solicited. It was a 'hey there's something wrong this is what we need to do.'
Barbara has been out of state on personal business and therefore unreachable. Now why her assistant hasn't contacted anyone, your guess is as good as mine.

Alert | I did email Barbara and got that out of town notice. So I emailed the other woman (Kara) and asked what was going on. She said that ballots had been mailed to all addresses, and that they had 13 ballots already returned. She made no mentioned of exactly when the ballots were mailed, though. She went on to tell me that she had attached a ballot to the email and that I could fill it out and fax it in. However ... there was nothing attached to the email, so I still do not have a ballot. I emailed her right back and let her no that there was no ballot, but she never replied to me. This was yesterday, so she is probably gone from the office for the weekend.
My concern is, if there is even one person (and I think there will be way more then one) who was not able to vote because they did not get a ballot, then this election was not fair. Could this potentially open our community up to a lawsuit from an angry homeowner?

Alert | | We received ours Friday. I dropped it in the mail Sat, not even thinking that we could have received it almost a week after it was actually due (sigh). So much for the vote for change.

Alert | *sigh*
I don't know, maybe those who sent one in can get a ballot from someone on here and vote. I'd date it and write that this ballot supersedes my mail in ballot.
I think we are going to have to have the HOA lawyer give an opinion. I still can't believe the ballots were sent out late and then not to everyone!
