Alert | And do tell.........how in the world do they think that they are going to "enforce" ANYTHING in a private back yard??? Really, this is getting to be way too much. Wonder if I will have to submit and redo my back yard, which has been done for 2 years.............it's almost laughable.

But then again, our City leaders should be able to know how to run the town under legal guidelines, and they can't get it right either. So who knows.

For an amendment to made to the CC&Rs a 2/3 majority vote of the homeowners must be obtained.
In my experience these kinds of things are either done at the annual meeting or in a special meeting that is required to have a quorum of the voting homeowners. | | | |

Alert | Ok so I heard that what was sent out was an amendment to the landscape guidelines. This may be but they do not super cede the CC&Rs and are just that guidelines.
I also heard the reason that this was done was because there are some backyards that are overgrown with weeds and they are growing over the fence. If this is so then this can be seen from the street and can be addressed that way.

Alert | I guess this is a rather old subject, and before you boo me, here's what I was able to find out and my take on the backyards. 1)They want you to have something other than dirt. When you bring in landscapers to do a lot of work all at once the dust is more prevalent. So both of these create blowing dirt, which we know holds Valley Fever and is an inconvenience to keep cleaning off outdoor furniture, out of a pool, and off our windows. Granted the Monsoon does it's share but why add to it. 2) Some people are allowing the regional weeds to run amok. The weeds draw insects and eventually go to seed. The insects and seed do not, unfortunately stay in their yards! Yuk! 3) Some folks have dogs that they do not tidy up after and the smell of their feces, mixed with the rain, is a horrid smell, which emanates to the surrounding neighbors. If the back yard is landscaped, people seem to respect their investment and take better care all the way around. 40 Some of the vegetation that the pool packages include do not receive the maintenance that they require and the dead leaves wind up in the neighbors yard and pools. If the proper vegetation is planted it is hardier and retains longevity. 50 Every time I have had to call our HOA I have gotten a return call within 24 hours. If my issue is urgent I try another angle until I have my answer. Now for the negative side of my opinion. Why aren't they enforcing the rules for the front yards? Weeds, trailers in the driveways, dead plants not pruned, and cars parked on the streets - to the point where you can barely back out of your drive. If there is a fire and the truck can't get through I don't care to be the one to take the lose! So, I do agree that until the fronts of the homes are 100% addressed and the parking, they need not spread themselves any thinner!

Alert | How do you know that they are not enforcing the rules? How do you know that the notices are not going but instead of just being ignored by the homeowners?
You can not make pull their weeds if they don't want no matter how many times you fine them. But the HOA can place a lien on their property when they ignore the fines long enough to owe enough. And the HOA can take them to court to have the judge order them to take care of violations. But see the biggest thing about all that is that it doesn't happen over night. The process takes a while.

I wish people would pick up after their dogs in the common areas. Not to mention the sidewalk areas and other peoples yards.
It's not hard to tuck a small plastic bag in your pocket and pick up.

Alert | You are correct! The HOA "so-called" board has not been doing things legally. In reference to the Landscape Action, they cited a Code from the AZ Revised Statutes which ONLY permits a BOARD OF DIRECTORS from a fortune 500 corporate entity to take action WITHOUT A FULL MEETING OF MEMBERS. This Statute they cited in the BACKYARD RESOLUTION is ILLEGAL, because there is only ONE TITLE UNDER THE AZ Revised Statutes, giving authority to HOAs, IT CLEARLY states that all RESOLUTIONS and ACTIONS must be approved by the MEMBERS, MEANING WE, THE HOME OWNERS. I called the AZ legal compliance agency and know what I'm stating is true.
NEXT STEP FOR US: LET ACACIA CROSSING HOA know we are on to them and that from this POINT ON, no resolution will be legally in force, WITHOUT THEM FOLLOWING THE CORRECT AZ REVISED STATUTES THAT PERTAIN DIRECTLY TO HOAs!!! NO MORE FAKING IT WITH BOGUS STATUTES THAT ONLY APPLY TO A REGULAR BUSINESS CORPORATION, SUCH AS A FORTUNE 500 ENTITY. We are not a regular Corporation doing business with products or services. We are a group of homeowners and therefore, the HOA BOARD must FOLLOW THE CORRECT SET OF STATUTES or ALL OF THEIR resolutions are ILLEGAL. LEGALLY, THEY CAN ONLY PASS A RESOLUTION OR TAKE ACTION WITH A REGULARLY CALLED MEETING OF ALL THE HOMEOWNERS!!!!!!!!!! | | | |
