Your backyard needs approval if it has a view fence. If your backyard can be seen from the common grounds then yes it needs to have an approval.

Yeah I heard about this from my coworker. This is pretty silly. I can understand the HOA getting on your case about the front yard but the backyard that is getting a little to pushy and ballsy. They shouldnt be snooping in your backyard and seeing what you do or dont have. What is next they are going to start sending notices that the backyard has weeds? Give me a break!!!!! In our subdivsion there are no view fences so for them to enforce this is pretty bogus and they have gone too far. I can see it in the future they will start looking through your open blinds and saying hey you cant paint your interior wall red. The board needs to start acting on items that really do need attention such as making sure that all front yards are uniform, that consistant violators get into trouble and etc. But, for them to be putting their big nose in my private property that is not visible by them just walking or driving by is none of their business. Just in case if you are wondering if I got a notice no I didnt because I have had my yard landscaped for a long time but for the others that dont have it landscaped I can certainly empathize on your displeasure with this.

I agree completely. It's a shame that the AC HOA has gone Communist on us, I think this is just silly. So long as you're not making explosives in your backyard I could care less what goes on back there, or what you plant or don't plant. Because my business is what's within my walls, not yours. The HOA doesn't seem to grasp that concept.

Well I thought it was crazy too, so thats why I needed some clarification. I do not have a view fence, but I didnt see this specific term in the notice so thats why I was asking. But what if your yard is already done?? I just dont get it.

So basically, if I understand, you need to have your backyard approved if others can see it from the common area?

If you backyard can not be seen from the street or common areas or is higher than the walls then you do not have to have any type of approvals.

If your uncertain as to why you received the notice contact your community manager for clarification.

I have not researched this yet, but I'm a bit concerned if the board is making amendments to our CC&Rs without homeowner approval. Has anyone looked to see if this is already in the CC&Rs? If so then it's just a reminder. I know there is another development in Maricopa that has a CC&R rule about backyards and it does not pertain to just those with view fences.

Time to make sure we are involved and active.

There is a backyard amendment on the HOA website. it is very vague and would seem to be lacking in any legal weight.

I had no idea about this one. Sounds like some sort of dictatorship, not an HOA. I've never heard of them having say so about your BACK yard. Seems like they are making LOTS of unwelcome changes lately.

I got the same notice. I don't know of any back yards in AC with "view fencing." The original specified back yards with view fencing. This new ammendment does not specify the back yards with view fencing.........could that be because there aren't any in AC??? But if you read it very carefully, the new verbiage NEVER mentions the back yard. I only read the change to be 90 days (old) to 1 year (new).

But really, AC is done, right? And front yards had a landscape package included (mine did).

I wonder if they screwed up the letter. I also wonder if they are trying to crack down on the additional landscaping that is being done...........besides the original, basic package.

Has anyone contacted Barbara Simser for clarification??

If it is the one that I got my gist of it was that they were sending it out for front yards. Since they had recently upped the fines they were showing people what the original CC&R's required. At least that's what I got from it.

Has anyone personally talked to someone on the board or HOA company about the details behind the notice? I plan on calling tomorrow, but last time I couldn't get anyone to return my phone calls.

I spoke too soon and need to edit my post. I just spoke to someone at the HOA and they told me that all homeowners HAVE to do their backyards regardless if it has view fencing or not. The main reason for doing this is because it’s a safety hazard not to have your backyard landscaped. I just thought I would update you all on what I was told just now.

A safety hazzard? Well, regardless, if what I signed in my original CC&Rs is not the same thing as what they sent out then the newest mailing is invalid.

I asked her about this being different from what I orginally signed, and she said that it didn't matter and our backyard was subject to the new rules. When I asked what legal backing they had on that (I'm not sure what exactly my rights are) she said I would have to talk to a board member and thats all she could tell me. Shouldn't they know the legal stuff if they are part of this?
