How does parking a car on the street make it unsafe? Also how does parking a car on the street make the street look junky? Drive through the older neighborhoods. They don't look junkie. Also there is no safty concerns. The bill to take parking regulations away from HOA's is back in the State Legislature. It the rate HOA's are gaining power soon they will tell you how many people you can have living in your house. Don't know the bill number yet. Chuck Grey is the sponsor.

AN ACT
amending title 33, chapter 16, article 1, Arizona Revised Statutes, by adding section 33-1815; relating to planned communities.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 33, chapter 16, article 1, Arizona Revised Statutes, is amended by adding section 33-1815, to read:

33-1815. Community authority over public roadways

Notwithstanding any provision in the community documents, an association has no authority over and shall not regulate any roadway, easement or other area for which the ownership or use has been dedicated to a governmental entity or that is otherwise under the legal authority of a governmental entity. An association has jurisdiction over only those roadways, easements and other areas that remain under the ownership of the association.

It does when they have a huge oil spot under the car and there are one or more flat tires. If it didn't look junky, why isn't it in their empty driveway?

Safety is an issue as well, when it comes to parking RVs on the street. This happens fairly regularly on streets near where I am, and when you combine that with cars on the other side of the street, plus kids playing around and in between the cars it gets very unsafe.

I hope the bill fails, I get tired of neighbors using the street for a junkyard.

The city has regulations about junk cars and RV's parking on neighborhood streets. My point to this is that I want to see HOA's only regulate the stuff they own and not the stuff they don't. If it was unsafe to park cars on the streets then the city should regulate it and not HOA's. If we continue to let the HOA's gain power then what is going to stop them from telling the home owners what they can and can't do on the inside of your own home as well as in your own backyard which by the way the courts have ruled that your backyard is an extention of the inside of your house. My feelig is HOA's should only regulate common areas and such.

Ask the people who lost there home due to a fire in Alterra (IIRC) a year or so ago.. their home was leveled because the fire truck could not get through in time.. Why? (pause for dramatic effect)... on-street parking..

Still it is not an HOA problem. It is a city problem. If the city deems that no cars are to be parked on the streets then let the city pass a law and have the city regulate it not the HOA's. They are not a government agency but they are trying to act like one. Traffic laws need to be address by the city, county and state period.

Not sure if there are laws to enforce it, but cars on the street is unsafe (kids on bikes, access to hydrants, parked close to the curb, etc...).  What really bugs me is people that park for sale cars, trailers, boats, etc.. on the street.

I believe it makes the street look junky as well.
