You guy's are incredible.... You are complaining about the rules of the HOA so why did you buy here knowing that it's an HOA community? The parking rule was clearly in the CC&R's. If you didn't like it you should have thought twice about buying here.


People need to read the posts to see that #1- the wording in RED's HOA is such that they are going to try and prevent overnight parking, but it was the wording that prevented them from doing much in the first place.

#2- ]I [/b don't have an issue with not parking on the street. Our cars are in the garage. Just because someone thinks up a solution doesn't make it a good one! Or even a legal one! How about everybody who gets a violation for a car that does not belong to them, send it to people who say we are complaining! That makes about as much sense as the solution from the HOA itself!

Please figure out what a poster is trying to say, before making a statement that doesn't even correlate to their thoughts.

We rented a house while this one was being built that had the same rules about no overnight parking. We got a letter in the mail from the HOA about someone parking in front of our house and we were going to be sited for it. All we had to do was call them up and explain that it's not our car, we also gave them our license number and that was it. No arguing was needed. In addition, when we knew that we were going to have guests over in advanced that required them to park overnight on the street, we just let them know and that was it.... It's just a matter of working with the HOA.


If you note in previous posts, more than one person has contacted the community manager, who states that prior notification is needed for visitors not to get violations, and if a car is in front of a house, and no notes are there then that homeowner will get the fine. You are referring to a different neighborhood in your circumstance, and does not correlate to what RED's HOA will or will not do.

Again, I am not against a solution. Cars do need to come off the street. It is a saftey issue. The streets are too narrow, the property sizes are too small.

However the solution to ticket a homeowner for a car that may not belong to them is not reasonable and as someone pointed out most likely not enforceable.

Ticket the VEHICLE OWNER, make it a city ordinance, and put in the next park or library!

I agree, the cars need to come off the streets. Anyone want to join with me and start a tow truck company in Maricopa? This will generate revenue for the Tow truck business owners and perhaps the city. Or perhaps wheel blocks are in order. Then they would need to contact the city to get them to take the blocks off, at a hefty fee of course!

I think they really are enforcing because several cars I know that used to be on the streets are now in driveways at night.

In most places, this is a city ordinance. Parking on the street can be a hazard to emergency vehicles...nevermind parking in front of a fire hydrant. I also hope they keep an eye on vehicles that park to close to a curb and parking on sidewalks.

If you have a 2 car garage and a drivway, isn't that enough for your 4 cars??
The streets look a lot nicer when they are clear too!

My street, Reis Drive sometimes has an RV on both sides. Mini Coopers have a hard time getting around them. Stickers and notices will be the first step. Fines will be given after that.

I have seen bright orange stickers on some cars, by Pima Butte. Still a lot of cars on the street though.

The bright orange stickers are from the Code Enforcement Officer for the City, not the HOA. I'ts just a warning, not a ticket. Has nothing to do w/ the HOA.
As far as I know, no one has been cited. At least no citations have been issued on my block as the same cars that have been parked on the street for years are still parking there every night.

Are the roads in RED public roads? Or are they private?

My reason for asking is this... It was approved in the 1st session of the AZ legislature this last year...

Section 1. Title 33, chapter 16, article 1, Arizona Revised Statutes, is amended by adding section 33-1815, to read:

33-1815. Community authority over public roadways

Notwithstanding any provision in the community documents, an association has no authority over and shall not regulate any roadway, easement or other area for which the ownership or use has been dedicated to a governmental entity or that is otherwise under the legal authority of a governmental entity. An association has jurisdiction over only those roadways, easements and other areas that remain under the ownership of the association.

They are public roads, but that doesn't matter because 1360 was not passed into law. It failed in the House Committee on Homeland Security and Property Rights.

Ok......so it's in the CC&Rs......whatever.....we have a 2 car garage and 2 car driveway.  However, my husband and I each have a car and have 3 teenagers who also drive.  Total cars....do the math.......5.  Where would you like me to park my 5th car?? In my neighbor's driveway?  We aren't allowed to triple up the driveway and have a car partially on the gravel yard......so I'm pretty well screwed with all of this.  I guess I have to tell my 19 yr old that he has no home and has to move out, just to make the nit-pickers that live around me happy.

It's absolutely ridiculous!!!!

If the HOA makes an exception for you, then where does it stop?  Do they make an exception for weeds or trash bins left out or purple paint or any number of things your weird neighbors might want to do to their houses?

You don't need extra space, you just need to make sure all 5 cars aren't there at the same time.

OK.....so make sure all the cars aren't there at the same time......hhhmmmm......ok so someone in my family can't be home everynight? That's ridiculous. Ok tomorrow night, you stay somewhere else, the next night, someone else will have to stay somewhere else, and we will all take turns not being able to sleep in our own beds.  That's the most assinine thing I have ever heard.  You know.....this isn't STEPFORD.  It's Maricopa.  Where I thought was still part of the United States of America.  Evidently, communism is still alive and well.  I am not kicking one of my kids out of the house everynight just so our cars aren't here.

Bonthomas - I know one of my neighbors has more cars than their garage/driveway could handle.  The way they fixed this issue was that they poured more concret on the side of the house towards the RV gate and parked one of their cars there.  Have you thought about doing that?  The HOA is fine with cars on concret, it's just when they are parking on the gravlel that it's an issue.
