I haven't been able to post for awhile due to the new system.

I could not believe my eyes probably about a month ago before "resurfacing" when I was not going fast enough in the right lane (remember everyone the right lane is for the slow people even going 70-75), when a BMW decided to drive right beside me on the right shoulder to get past me. I had thoughts of moving to the right to knock off the person but I didn't. It would have probably killed me doing it. What I do suspect though is that all of these idiot drivers will meet their fate sometime in a one car fiery accident. Everyone thinks they're an "expert" driver but your time will come I promise...........

If it was a black BMW I believe I've run into this person, while going past the cement factory I was going 70+ in the right lane and he came around me on the right shoulder, into the intersection and into the truck lane to hit the after burners to the I-10.

But I caught up to the guy and we got onto the I-10 at the same time, his number will come up eventually though.

There are bold pilot and there are old pilots; but there are no old bold pilots...

I love when they do that crap and then I pass them on the I-10 as I go into the carpool lane and they are stuck waiting in the I-10 parking lot!!! HAHAHAHAHAH!!!!

yup.. just more fuel to add to the fire of "Keep Right Unless Passing".. If the selfish person wasn't hoggin' the left lane.. the Bimmer wouldn't have endangered you in the right lane..Not justifying the Bimmer, BTW..

Pull up the proof.. it for the right turn merging traffic .. not a passing lane.

Just doing it one day at a time. Change is good and it should be looked upon as an improvment! not a problem.

That would make it three cars wide going through the intersection! I don't think that meets the "When safe to do so" criteria for passing on the right.

White SOLID line for that lane. That's like people on I-10 getting over to the far right lane for each exit and riding it to the end and hopping back on the freeway before the exit. I have seen them pulled over for that! Unsafe Lane Change. No crossing the gore points etc...

How many times to we have to go through this? There is nothing illegal or inherently unsafe about crossing a solid white line.

I'll do it when I'm stuck behind some yahoo going 55 in the left lane alongside someone going 55 in the right lane.

OK, first things first. There is no sign that says "Acceleration lane only" or "Merging lane only". So first we come to:

28-644. Obedience to and required traffic control devices

B. Any provision of this chapter that requires signs shall not be enforced against an alleged violator if at the time and place of the alleged violation an official sign is not in proper position and sufficiently legible to be seen by an ordinarily observant person. If a particular section of law does not state that signs are required, that section is effective even though no signs are erected or in place.


There are no signs in place and no laws in place designating that as passing prohibited. Now we move on to crossing a solid white line:

28-641. Traffic control device manual and specifications

The director shall adopt a manual and specifications for a uniform system of traffic control devices for use on highways in this state. Except as provided in section 28-2416, the uniform system shall correlate with and as far as possible conform to the system set forth in the most recent edition of the manual on uniform traffic control devices for streets and highways prepared by the national joint committee on uniform traffic control devices.


So we're referred to the federal MUTCD which says:

Where crossing the lane line markings is discouraged, the lane line markings shall consist of a normal solid white line.

Where crossing the lane line markings is prohibited, the lane line markings shall consist of two normal solid white lines.


So, because it is not a double white line, crossing is not prohibited. It is discouraged because the primary purpose of the lane is to allow trucks to accelerate. It is not prohibited though, because there are not always trucks accelerating in that lane.

So, as long as that lane is clear there is nothing unsafe about using it for passing.


Now inevitably someone is going to complain that it's actually 55 through there and I shouldn't mind waiting behind people. I'm clarifying that because I mean drivers who are going 55 in a 65 and this is my only chance to pass them. I'm willing to risk the $15 waste of finite resources ticket for going 65 in a 55.

Not making fun of you Jason....just was inquiring. Anyway finding the laws is one thing but interpreting them is another since they're not in English. I guess that's why we have lawyers that can bill at $200-$300 an hour.

I looked this up through the Motor Vehicle Division and a solid white line is used in two instances in AZ. Solid white lines are used for turn lanes and to prevent lane changes near intersections.

They're in English. It's just a misconception that it takes a lawyer to interpret any law. Really, if you read our traffic laws, they're quite approachable.

As for the MVD driver's license manual, that's a joke. It's not really worth the paper its printed on.
