Alert | | So tonight i was on my home from work when turning off the I-10 onto 347 south i noticed a lifted up truck (Grayish with chrome big grill bumper and chevy silverado) when getting up next to the vechicle the female driver had a very young child sitting in her lap in the driver seat. she gets up to riggs and while driving slowly and trying reach into the back seat and buckle the kid. very wrong in my opinion. how many people have get injuried on this deadly road. this was all in the heart of a very serous accident already. | | | |

Alert | | you should have called the cops right away. atleast taken down her plate number. i have two children, 7 and 3, and the car absolutely does not move w/o them strapped in. my 7 year old occasionally gets whiney w/me that she's too old to sit in a car seat. shut up, sit down, and strap in. i believe it's a fed law that says a kid must be in a car seat til 4yrs AND 40lbs, whichever comes LAST. the state i am from also suggests booster seats until a child is 80lbs AND 4'9". it's not a law, but a suggestion. i do not know what arizona laws state, but my 7yr old, 49lb, 4' tall daughter is going to be best friends w/the booster seat for years to come. | | | |

Alert | There is not a federal statute for carseats. Although, I'm certain federal funding would be in jepordy for any state w/o one. AZ has the MOST LAX carseat laws of all 50 states. The law is 4 AND under must ride in a carseat. There is no weight or height limit. If there are not enough seatbelts in the car for the amount of passengers, and one child is properly buckled, all other are exempt. Yes, that's right, children can legally ride w/o a carseat if there are not enough seatbelts.
There is a number you can call (and should) to report carseat violations it is 1-800-505-2229. You must have the plate number.
In terms of other safety laws which people assume AZ has, but AZ does not:
Helmet laws (motor and bicycle) - none Seatbelt laws - passengers riding in the front seat only are required to wear seatbelts Riding in the bed of truck - legal, has some qualifying information (age, or position, something, I can't remember) Booster laws (fall under the 4 and under carseat law only)
The most important thing to remember is to not allow the gov't to dictate the maximum safety precausions you are willing to take. Carseats and boosters maximize safety, as do seatbelts and common sense. I wish I saw a whole lot more 7 and 8 yr olds in boosters. . . as it is, my DS is the only 8 yr old I have EVER seen in a booster. | | | |

Alert | Actually the law is 5 and under. In my personal opinion the fine should be MUCH higher.
According to the Arizona State Legislature:
A. Except as provided in subsection G of this section, a person shall not operate a motor vehicle on the highways in this state when transporting a child who is under five years of age unless that child is properly secured in a child passenger restraint system.
B. The department shall adopt standards in accordance with 49 Code of Federal Regulations section 571.213 for the performance, design and installation of child passenger restraint systems for use in motor vehicles as prescribed in this section.
C. A person who violates this section is subject to a civil penalty of fifty dollars, except that a civil penalty shall not be imposed if the person makes a sufficient showing that the motor vehicle has been subsequently equipped with a child passenger restraint system that meets the standards adopted pursuant to subsection B of this section. A sufficient showing may include a receipt mailed to the appropriate court officer that evidences purchase or acquisition of a child passenger restraint system. The court imposing and collecting the civil penalty shall deposit, pursuant to sections 35-146 and 35-147, the monies, exclusive of any assessments imposed pursuant to sections 12-116.01 and 12-116.02, in the child passenger restraint fund.
Skip to G.
. This section does not apply to any of the following:
1. A person who operates a motor vehicle that was originally manufactured without passenger restraint devices.
2. A person who operates a motor vehicle that is also a recreational vehicle as defined in section 41-2142.
3. A person who operates a commercial motor vehicle and who holds a current commercial driver license issued pursuant to chapter 8 of this title. 4. A person who must transport a child in an emergency to obtain necessary medical care.
5. A person who transports more than one child under five years of age in a motor vehicle that because of the restricted size of the passenger area does not provide sufficient area for the required number of child passenger restraint devices, if both of the following conditions are met:
(a) At least one child is restrained as required by this section.
(b) The person has secured as many of the other children in child passenger restraint devices pursuant to this section as is reasonable given the restricted size of the passenger area and the number of passengers being transported in the motor vehicle.

pick and choose which child you want to live threw the crash?? XXX!? if you don't have enough room to strap in your kids, get a larger auto! i just can't imagine driving anywhere (347 or threw my little subdivision) w/o my kids strapped in! how can people be so ignorant!? | | | |

"Child who is under five years of age" is the same as 4 AND under, not 5 AND under. Once a child is 5 yrs old the carseat law is no longer binding. These types of wordings (the 'ANDS' and "UNDERS") mean everything. . . | | | |

Alert | | I have a 4 yr old daughter who hates her car seat but deals with it and a 20 month who deals with it i was very upset with what i saw and i did get her licence plate and called dps on her they responded they were to busy with the accident already. now i have the phone # for carseats i will call. | | | |
