Alert | 67 would never hold up in a court of law. 3% is an acceptable margin of error for car speedometers, plus the calibration factor for the gun the officer is using (our police officers use ones calibrated to within 1 MPH accuracy), so if your speedometer is reading 65, the officer could potentially read 68 MPH on his/her gun.

Alert | LOL, Jason, I just love annoying you. It is all in good fun. However, regarding speeding, it does depend on what one is charged with. AZ 28-701a would be hard to get someone with at 67-74MPH. On the other hand az28-701.02A1,A2,A3 would be easy to hit someone with. If you are doing 45MPH on the 347 with a driving dust storm, you can be charged and guilty of 'Excessive Speed'. Just something to think about. 68 is illegal. It may be acceptable, but it is still a stoppable offense. Yes, we all drive 70-75 on the road. | | Let X=X | |

Alert | Stay left except to pass (which I pretty much try to do and even if someone is up my butt, but I am still passing cars on the right "it is my right since I am still passing").
There are approximately 33,000 people commuting to and from the Phoenix area every morning and evening. There is not enough room on the 347 to move everyone to the right to allow those who want to speed to continue on the left. I'm not quite clear why we continue to argue about this. Basically there are too many cars for this stretch of road. I say deal with it as the 347 has become a little like I-10 from Chandler to the Broadway curve (there is no stay left except to pass signs because we're all packed in 4 lanes moving vey very slowly).

Because a speed limit of 65 MPH is posted on 347, even during a driving dust storm you couldn't get them for excessive speed, unless you were going 85. But don't worry, there are plenty of other things that would apply, if 45 is truly unsafe. I say that, because I've been in a few where traffic safely proceeded at 55. Visibility was good for about 1/4 mile which is plenty for 55. I would be afraid to go slower and lose sight of the car in front of me. | | Joined: Jul 2005 | |

Alert | Nice. Prima Facia law states that you can't go faster then the posted speed. Arizona law states that you can't drive faster than road conditions allow. 45 in a 65 may be considered speeding, if driving conditions dictate this.
Yes, you can be ticketed in a 65MPH zone while doing 35... If the conditions on the road require drivers to do 25MPH. Don't fight this. This is the law, I have a ticket to prove it.

Alert | "reasonable and prudent" is the rule. That is the issue, Over and over, we want to decide what is "reasonable and prudent" on the 347. With and without construction. To me, "reasonable and prudent" means that other cars don't try to run up to my son in the back seat. I do move over, but, darnit, nobody needs to drive 85 MPH. (And they do) Too many people consider the 347 a raceway!. 65 is posted, 75 is expected. 90 and 111 is nuts. | | Let X=X | |
