 Alert | | Today I witness the most crazy accident ever. A man in a grey truck with a trailer making a left hand turn in the left turning lane as if he is going to Cirle K or Basha this morning was stopped because of all the traffic. This nice man back up his vehicle so the man in the grey truck could go. The man in the grey truck pulled out slowly since no cars were comming and as he got almost to the other side this crazy man in a white truck pulled out from behind about four cars and floored the gas and hit the grey truck in the side rear corner panel. Since I was going to get gas and in no big hurry I was wondering if the guy who hit the grey truck was alright since his truck was missing the whole front gril. It was clear to see that the guy driving the white truck who hit the grey truck was in the wrong. I was amazed at what happened next when Maricopa's finest arrived the police officer asked the man in the grey truck if he was hispanic the man told him he was Puerto Rican that must have been the wrong words. Here come two more of Maricopa's finest telling the man in the grey truck he was in the wrong for not yielding at the intersection this poor man was trying to tell the police he was at a complete stop and this guy in the white truck came from behind other cars and hit him when he was almost across the street. This man was told they did not care he was at fault and needed to go to traffic school. I could not believe my ears I just continued to Basha's. A white person hits a Puerto Rican person in the side of his vehicle Maricopa's finest treats the Puerto Rican like he is a criminal while laughing and joking with the white man. Is this racisism or what? I hope other people saw this accident this morning because this was crazy | | | |

Alert | Why didn't you stay and be a witness? That doesn't make you any better than teh MPD. If you heard and seen so much.. nad were in no big hurry, Assist the man that is being wronged.
Well.. I guess you had your reasons for continuing on to Basha's and leaving someone to get rail roaded by the MPD.

It may have been clear to you who was at fault, because you watched it happen. The MPD was not afforded the same luxury though. I'm guessing this was a case of one drivers word against the others. Somebody had to be at fault, and unless witnesses come forward to corroborate one story or the other, failure to yield to moving traffic in an intersection is the only call that can be made. Obviously what happened bothered you enough to post about it here, but I don't understand why you didn't stop to tell the MPD what you saw if you had enough free time to stick around to see how they treated the guy in the gray truck. | | | |

If you are here legally, then what did you have to fear? Surely no gallon of milk at Basha's is worth giving up the righteous defense of an innocent individual.

A person making a left has to yield to oncoming traffic weather or not he was "waved on" by a stopped vehicle in a backed up lane.
Do you think they were asking the mans nationality to maybe help interpret? Or check for citizenship status?

Alert | | Unfortunately being in the left turn lane does not give you the right of way. My brother had the same thing happen to him in michigan and he got the ticket. You can also get a ticket for getting in the left turn lane too soon (they consider it travelling in the left turn lane). My sister got a ticket for that one. | |

Alert | Don't forget that the MPD must fill out an accident report. All information contained within must be accurate. That means they must accurately describe all vehicles and drivers involved. I could not tell the difference either and would have said hispanic. Puerto Rican is not hispanic which is so often considered Mexican. This is not a case of racism but of getting accurate information for the accident report.
Also realize that no matter what, witness or none, the grey truck was at fault for not yeilding to oncoming traffic. | | | |

Alert | It's difficult to tell but it actually sounds like the grey truck had the right of way. Vehicles turning within an intersection have the right to complete their turn, as long as it is safe to do so. When the truck started turning, it sounds like the white truck had not begun its lane change. If this is the case, then the white truck failed to yield right of way and failed to control the vehicle to prevent a collision.
The law is designed to prevent just such an occurrence. Vehicles in opposite turn lanes of you are not allowed to change lanes and get automatic right of way. | |
