I remember reading somewhere (here?) that commercial vehicles can be allowed if their job requires them to be ON CALL. Does anyone have any info on this or a link to an article?

33-1809. Parking; public service and public safety emergency vehicles; definition

A. Notwithstanding any provision in the community documents, an association shall not prohibit a resident from parking a motor vehicle on a street or driveway in the planned community if the vehicle is required to be available at designated periods at the person's residence as a condition of the person's employment and either of the following applies:

1. The resident is employed by a public service corporation that is regulated by the corporation commission or a municipal utility and the public service corporation or municipal utility is required to prepare for emergency deployments of personnel and equipment for repair or maintenance of natural gas, electrical, telecommunications or water infrastructure, the vehicle has a gross vehicle weight rating of twenty thousand pounds or less and is owned or operated by the public service corporation or municipal utility and the vehicle bears an official emblem or other visible designation of the public service corporation or municipal utility.

2. The resident is employed by a public safety agency, including police or fire service for a federal, state, local or tribal agency or a private fire service provider or an ambulance service provider that is regulated pursuant to title 36, chapter 21.1, and the vehicle has a gross vehicle weight rating of ten thousand pounds or less and bears an official emblem or other visible designation of that agency.

B. For the purposes of this section, "telecommunications" means the transmission of information of the user's choosing between or among points specified by the user without change in the form or content of the information as sent and received. Telecommunications does not include commercial mobile radio services.

So what recourse does a person have when a neighbor uses a vacant home (it does have an owner) to park his commercial truck in it's driveway. This truck is BIG, and although it is new, it is still not supposed to be there. I know this neighbor also runs his landscaping business out of his home and I am suspicious that his family also runs a daycare from there as well. I am thinking that neither business has a Maricopa business license.

Do I knock on the door & tell him what I think? Do I just let it go? Do I call MPD? The HOA?

I am thinking that I paid a LOT of hard earned money for my home & I know everyone has a right....and I am sure this guy paid handsomely for his home too.....but stil..............

There's nothing that the MPD can do since it is private property unless the owner of the home complains and files trespassing charges.

The HOA can send the owner a violation notice but unless you file a written complaint then there really isn't much that they can do unless they catch them parking there during their normal drive thur.   But the best part if they are caught by the HOA then it will be the owner of the driveway that will get the notice not the owner of the vehicle.

As for the business license issue.....are you sure that they don't have the necessary licenses and does it really matter?   Maybe babysitting is the only way that they can make the needed money to buy food and gas.  As for the landscaping business unless they receive deliveries all day long or are making abnormally noises because of the business I can't see why it would make a difference to you that they have licenses or not.

At least it isn't a vacant house that the weeds are being over taking the yards or people are breaking into it, living in it and trashing the heck out of it.   Seems strange to say but I would be happy that they are there and working.....means that they are less likely to loss the house.

You need a lic. from the state not Maricopa city, If it bugs you so much go talk to them and see what they tell you.

Maricopa requires a Maricopa Business License from anyone making any kind of Monetary transactions within the City limits. That I know forsure.

You should park the truck in the garage or behind an RV gate out of sight. It is safer for theft and makes the home look better

You should check your governing documents to see if they restrict commercial vehicles.  I would have to guess by what most of them say that they are not allowed.

That would really suck since my hubby has a company vehicle that does not fit in the garage and he NEEDS it for his job. We have never been bothered with it for the 4 yrs we have lived here. I was just wondering since I saw the topic.

If it's a work van that fits in the driveway, it should be fine. If it's a cargo truck that is large, it shouldn't.

You can also inquire at the Arizona DES, as I am pretty sure they do the day care licensing. No one can take care of more than six (6) children who are not their own children, without having a day care license. This is to protect the children of our state, so, if your neighbors have more than six kids, who are not theirs, and the state finds out, they will be in trouble. Also, I am sure the CC&Rs for your HOA do not allow a business to be run out of the house, and unless your neighbors are carrying hefty liability insurance, if a kid got run over outside of the house, or hurt in any way, your neighbors would be facing financial problems, as regular homeowners insurance does not cover stuff like that.

In addition, if the house is a rental, the owner of the home may be opening themselves up, if it could ever been shown they knew a day care was being run out of the home. People cannot simply decide that they can break city and state laws, and figure they will not have to face the consequences at some point. I would contact the City and the state, and see if they can help you.
