Alert | lets start off with this. dont count on the HOA for nothing!! I talked to them the other day about something. the reply was we dont have enough money. HOA is now putting their problems on to the city of maricopa and they dont want to do anything because the HOA is getting paid by us. So I sat thinking about this we should just do a patition and throw the HOA out. why pay for nothing.

I called DC hoa they said they have no money to have someone take care of this issue. For me to call the city and ask them for money. The city said they were probably investment homes and they would check into them and send a notice. Does this make sense?? Alert | I fully understand exactly what your talking about and which houses your are referring to. Yes the HOA has been in contact with the city so that they can be formally fined as a hazard. I guarantee you the homeowners in question have been fined over and over again and are in the legal process of the fine policy.
The cost to utilize the "self help" clause of the governing documents would cost over $200 per house...this is because of liability issues. You are correct about not having extra money because the homeowners are not paying their dues.
You can not make a person pull their weeds or pay their dues if they don't want to. People will only do what they want when they want. The only recourse that the HOA has is to fine and lien when and where necessary.

Alert | Amazing but there are people who don't pay their dues but they obtain a lien on their house when their account gets to a specific dollar amount. All costs are also passed onto the homeowners.
They can and do receive fines over and over again but don't always pay them. They also receive a lien on their house for those also.
