NOPE.

So much for freedom of choice. It's written into the HOA "rules"

Seems that these HOAs may have gotten a kickback for that, don't ya think??

No kick backs.  The HOA's didn't negotiate the contracts.  The builders did.  After turn over to homeowner HOA status and the contract ends you don't have to renew it.

Can't say yes and can't say no on that one.  But I do doubt it with everything that has to be public. 

But you just never know now a days.

Call Orbitel everyday, because your cable reception isn't 'right'.  Eventually they will tire of you and cut you off and you won't have to pay anymore.

If you pay the bill within your dues don't think that it will work since the HOA is actually paying the bill.

The sad part is that no matter which way you look at it the community is locked into the contract for the length of it.  If your unhappy I would find out when the term is up and ask the board to look at alternatives for the contract .

Ask the Board for a copy of the meeting minutes were they approved the contract. If they did not approve it during a meeting, ask for a copy of the contract, and if they do not have it, ask for which CC&R spells out the requirement to pay this fee. There has got to be something in writing, otherwise it would be impossible to require payment.
You may also want to check with the AZ Attorney General's Office, as there was a lawsuit a few years back that alleged that a cable service created a monopoly with a developer by signing a contract, thus not allowing homeowners to select their service. From what I remember the Attorney General voided the agreement, since neither the Developer, nor the HOA are a governing body and as a result, they cannot create a monopoly.
