Well, the HOA dues came in the mail yesterday. The newsletter had a reminder about parking guidelines:

Visitors can NOT park on the street.
Residents can NOT park on the street.
No parking in fire lanes.
No recreational vehicle on any part of community.

Vehicles in violation are subject to being immobilized. $90 to remove "boot".

The part that bothered me was about the coach lighting:

"Per the association documents, a photo cell was installed on each garage light at the time of construction.
The lights operate automatically, to remain on from dusk to dawn.
The owner of the lot must maintain lights in good repair and working condition at all times. It is also the owner's responsibility to change the bulb when it burns out."

If I turn my lights on during the day, they are on! There is not a sensor that tells them to be off. Does anyone know for sure that they have a photo cell? Do just certain subdivisions have this? I am in the Homestead homes...

And once again, landscaping requirements. What irritates me about this is that they can't get people to remove weeds from their front yards (some on our street have their entire rock areas covered in that green moss-like weed), but yet that are worried about what I do or do not have in my backyard? Can we worry about making it look nice when everyone drives down the street, not when a few someones look over my fenceline?

I also got the latest HOA newsletter. The lights on my garage also do not have a photo cell....when I turn them on, they will stay on until I shut them off. I don't understand how they can require people to have their lights on all night, every night - they don't pay the electric bill, I do !

That was wrong information put out by AAM. And yes the board is trying to resolve these issues with AAM. So don't worry you can have your house all nice and dark.

Bottom line is read your CC&Rs they are the guiding factor and override anything that is published. They can write or say anything that they want but if it conflicts with the CC&Rs it is a mute point.

The parking statement is also incorrect. It conflicts with the CC&Rs that state you can use the street as temporary parking but shall not park there overnight.

Section 5.6 All vehicles of Owners and of their lessees, employees, guests and invitees shall be kept in garages or residential driveways of the Owners wherever and whenever such facilities are sufficient to accommodate the number of vehicles on a lot, provided, however, this Section shall not be construed to permit the parking in the above described areas of any vehicle whose parking is otherwise prohibited by this Declaration or the parking of any inoperable vehicle. In the event the garage and driveway is insufficient for parking, temporary parking shall be allowed on the street directly adjacent to the Lot, in no event shall overnight on street parking be allowed on any Street and in no event shall an Owner or occupant park on a temporary basis on streets other than directly adjacent to such Owner’s or occupant’s Lot. Parking in the front or side yard of any Lot is prohibited. No part of any vehicle may be parked over any part of a sidewalk because such parking may impede use of the sidewalks, particularly for persons with disabilities using the sidewalks.

I received an email that states there indeed was a misprint with the parking regulations and coach lighting portions of the newsletter. A new first page will be sent out with no charge to the HOA because it was AAM's fault!
