OK, so about 6 months ago I rec'd an email (not a citation or a letter - which I thought was odd....) anyway...I rec'd this email from the HOA asking that I place my trash & recycle bins on the street & not the sidewalk so as not to block pedestrians. Makes sense to me, but I've always placed them on the sidewalk so that even the largest of persons, or strollers could still pass whether my bins were there or not. Anyway, if it's a request per the HOA, then I'll go ahead & abide....God forbid I not!

In the email it also stated that "soon" everyone that does not abide by this request will start to get warnings & citations for placing their cans on the sidewalk. I told my closest neighbors about this email so that we can all be on the same page as I assumed not everyone rec'd the email since it appeared to be sent to me alone.

So, here it is, many months later & not only is my entire block sans the 3 of us all in a row, + hundreds of other houses in RED continuing to put their cans on the sidewalk, but it doesn't appear that any enforcement is being done.

Has anyone been attending the HOA Mtgs. lately & can address this particular issue? I believe a few newsletters ago there was a request for cans being placed on the street, but that's all I've noticed.

This seems trivial...and to be honest, I believe it is trivial, but it's been irritating me for the past 2 months.

Thoughts?

We got the same email, and I wondered how the HOA was going to enforce this as well. I noticed sinced that email, that when Waste Management comes through, many times the can is placed on the sidewalk instead of the street after dumping it. I have actually witnessed the driver pick it up from the street and empty it and then set it on the sidewalk.

How will the HOA know if the resident or WM did it? Are we now responsible for WM's behavior as well as our neighbor's vehicles? ( But that is another thread!)

I too see no need for a special place for trash cans. Many times they interfere with traffic, street sweepers, visibility when backing from a driveway, etc. . . . . Not heard anything more from the HOA on this either.

Every City that I have researched has a law or code regarding this issue for public safety reasons (e.g. pedestrians, strollers, wheelchairs). Most likely the impetus of the e-mail that you received, was due to a complaint from a concerned resident.

FYI: The City of Maricopa is currently working on amending our garbage and recycling codes.

We didn't get it, but our neighbor did. They asked us if we got it. I said no. But we do not put the cans on the sidewalk... Just thought that was common sense... but yeah I see about 90% of them on the sidewalk..

There is no such city ordinance in Maricopa right now - just like there is no "on street overnight parking" ordinance. It's one of those things that the HOA tries to enforce but that they really have no juristiction over. I know, I know.....another thread altogether!

As far as common sense, I personally think it's common sense to not block the streets.

When I placed my can on the sidewalk, there was 3+ feet available for pedestrians w/ or without strollers & ample space for wheelchairs. I hate to be argumentative, but I'm in anywhere from 2-6 Maricopa Master Planned Communities daily. I see many more cans on the sidewalks than on the street.

OK, so clearly this is a bit of an irritation for me, but I'm over the fact that I just have to put the cans on the street and behappy about it. My main issue is when there was no complaint (and I asked about that specifically) why did I receive the email & why is this not being enforced since the email clearly stated that it would be strictly enforced.

Sorry, I didn't mean it that way. I guess I just used a lack of a better word.


It's hard for us to walk our dog on garbage days cause we have to walk around about 100 cans. The dog used to go this way, then that way.. You don't want to be walking in the streets.. ya get run over..

But Its good to see they are sending stuff out. Someone should also post this stuff in the "General Section" so everyone can see..

We recieved the email from our landlord. Personally, i think it's great. We've always put our trash can on the street.

It bothers me when my daughter has to ride her scooter around the trashcans. Our sidewalks are very narrow, so i don't see how you can put yours out there and still have enough room to stay on the sidewalk. Most poeple don't put them close to the street. They set them in the middle of the sidewalk.

Trash cans are relatively small and easy to maneuver around. Cars are larger and with one on each side of the street can make it more difficult.
