I am on the verg of having to cancel out of our new build, due to the fact we haven't sold our current house...Here is my problem, if I cancel they are offering it 40,000 less than what I was about to pay, shouldn't they offer it to me at that price? It would make a huge differance on being able to get financing. I have tried to get them to give me the price they will be selling it for and they say they can't. I don't understand, were is there customer service and keeping there customers happy, I am a repeat buyer and am getting nonthing from them but BS. If it wasn't the house of our dreams I would love to tell this builder to piss off and blog them with no dis-reguard. I just don't see how they can do this, without offering it to us first? We asked for a discount (this day and age everyone is marking down there houses, why shouldn't builders, we also asked for a time extention and were told NO on both accounts) Does this seem fair, its hard for me because I am emotionally attached to this house so I am looking for an outside opinion

Hi,
Legally the builder does not have to lower the price. But most builders will lower the price if the prices decrease before the close of Escrow. Depending on how much you put down, it may be cheaper to walk away and buy another house.

I spoke with a manager today and was told the reason the price is lower is because it becomes a spec if/when we cancel our contract...thus whomever buys it didn't get the choice of colors, upgrades, cabinets, lot, etc. Our house was located on a corner lot with tile, upgraded carpet, cabinets, r/o, sink in garage, epoxy garage floor, lights, outlets etc...to say the least when we made it our house that we were planning on staying in for a very long time, made it very nice...so I guess who ever gets our house gets the best of both worlds, great lot, tons of upgrades and a unbelievable price...too me its just not fair that they would give someone else a better deal then a repeat customer.

If there wasn't another back-up offer sitting on my house I would have someone else go in and get it at the lower price, but now its to late. Hoping this company does the right thing and works with me. This is no way to treat customers, no matter how big your company is. If they choose not to meet me half way, I will make sure everyone know the company name and how they treat there buyers, and will never buy from them again!

I hate to take the builder's side on this since my wife and I have had issues with new home builders in the past but I don't think they're being unreasonable.

This is how I understand your situation:
1. You purchased a new home from builder
2. You chose options for the home that suit you, and maybe not everybody else.
3. You signed a contract that probably said you're going to buy the house and if you cancel you don't get all deposits back, etc.
4. You're now dropping out of the contract because you weren't able to sell your existing home.
5. The builder now has a complete (or nearly) home with options that nobody else may like and so they're lowering the price to get rid of it.

Was this a contingency which stated that you must sell your house? If so, hopefully you at least able to get your deposits back.

Pretty much all builders build spec homes and the prices are often lower because you don't get your choices. We're selling and buying a new home right now so I feel your pain. But it's kind of tough to say "since we need to drop out of the contract, which will cause you to have an empty home sitting out there which will cause you to lower the price, why don't you just give it to us for a much lower price than we originally bought it for."

Maybe I don't entirely understand the situation and I'm missing something?

Hi Colgate--I may have misunderstood you before. I thought the base price of the new build had dropped in price. Then almost all homebuilders would lower your price if you did not close on escrow.

All home builders specs are priced below a new build. I don't buy the fact that the builder has another buyer. As you can see, it's never a done deal until the day you sign the papers at the title company. They may be telling you this so you don't cancel. Also if the house does not have everything in it yet, and you cancel, the builder may not add all of your upgraded, carpets, blinds, flooring and garage apoxy. So yes a new buyer may get it at $40,000 off but they will be charged for some upgrades.

You also mention that it would be easier to finance if they lower the price. You will have to check this out but if you can not get approved for the loan, they have to give you back your deposit. Double check on this with your mortgage guy and look over your loans.

I know it's hard and you get so emotionally involved but if you can't afford the home, but can still get approved for financing, it may still be better to walk away. Especially if you put down a minimal amount of $$. You can go and get yourself a spec home from another builder and save quite a bit of money. There are many specs out there and you can find a dream home and still be able to add some upgrades.

Who is the homebuilder that you are working with? You will want to check their website to see if the prices of the newbuilds have gone down. They usually won't tell you that they have but you can check on their website.

Things just took a turn for the worse and I will never ever work with DR Horton again and will make sure everyone know how they treat their buyers, its unacceptable!!! Stay away from them

Oh DR Horton. Largest homebuilder with poor customer service. You can look up the homebuilders customer service ratings for metro areas throughout the country on JD Power and Associates websites. DR is way down in the rankings.

I think Pulte gives you the best bang for your buck with standards vs upgrades, plus they have pretty good incentives. I like the Shea houses and incentives.

What Hacienda neighborhood? The Lakes at Rancho El Dorado are offering a pool (or cash) and $5000 right now I believe. Also, on the website there's a $1000 design studio incentive. After we bought ours we kept checking the web and calling them to ask if they have any more incentives. Get to know your salesperson and they should try to help you out as well.

I 2nd Pulte, really the best built home. If you go ask for Nancy Harwood she is amazing. I have had 3 new builds (4 contracts) and of all 4 she really knows her product and has excellent customer service skills. I wish she could have helped us with our current home.

Pulte is good but you also have to look at the Community. All the homes in Senita 3 are so close to the railroad and you will be sharing the neighborhood with a lot of rentals because of DR Horton which is one of the worst builders when it comes to customer service ratings. According to JD Power and Associates the top 3 builders in the Phoenix market that are in Maricopa are Pulte, Shea and Standard Pacific.
