yes please expand on your thoughts. Btw does anyone know if our current company or ogden is saposed to spray for bugs... there are ants everywhere in the neighborhood.

I just find it intresting that the current company carries min. insurance, rather aviod most questions, and seems not to be licensed... while H&N is jumping through hoops trying to get a bid in and Kriss seems to be holding things up and seems to be not so forthright with info on the whole thing... I just find it fishy all the way around. Maybe it is just me. I mean I could care less who does the landscape as long as the job is done right and looks good. The ants are really bad along Santa Rosa Parkway they have a hill about ever 3 ft on the sidewalk.

Well as i understand it when we all moved in the current landscaping companie was already chosen (either by Ogden or by our builders) and a contract was signed for a certain amount of time. and at the last meeting the guy from our current landscaping company (foylege landscaping i believe) talked with us and stated he does not have a contracters license. we think he should have one and H&N has one and willing to get our business.
- my guess is that we have not switched to H&N becuase we still have a contract with foylege at the moment, but once that goes away we will have a meeting to vote on our new landscaper.

Money isn't everything.

Foleyge's landscaping contract can be cancelled with a 30 day notice. Not a long term contract.

I'm no lawyer but if the current landscaping company doesn't have a license how can they hold someone to a contract when they are no even suppose to be operating?

Who's going to pay for the law suit when one of his workers gets hurt and can't get any money when workers comp finds out that they are operating without a license and they deny the claim.

As long as the management company knows that there is no license then the HOA is wide open for a whole bunch of problems that I don't really think that anyone has thought of.

I have a question? Why are we not voting to get another landscape Co. that does have the proper paperwork to protect our HOA? Does someone need to motion this at the next HOA meeting? Also, am I right in saying that this H & N Company is willing to charge us less money for the same or more work? DUH........I think we have an answer.

Go to the next HOA meeting on 6/4 at 6:30pm at Pima Butte Elementary School and ask the HOA board why they keep the current landscaper. If you want change, let the HOA board know by showing up and telling them. I agree with you.

I am new to senita and this website. (I was actually looking for our HOA website but this will do). I agree with everyone here. This makes no sense to me. Does Ogden read this website at all or do we have to wait until the next meeting to voice our concerns which I am sure we will be cut off due to the "time constraint" like last month where no one except Foley and Ogden were allowed to speak? I had heard Foley state the reason he didn't have a license was because it was only a "marketing scheme". That sounds like BS to me. Can someone explain to me how hiring an unlicensed contractor for ANY work benefits me the consumer/homeowner? Also, with the economy and gas prices as it is why would we hire someone who is not local? Isn't he based out of Glendale thats like 50 miles away? I am sure that WE the homeowners will somehow be charged for the high cost of just him getting down here. He'll probably pass the cost of gas (which alot of people are doing these days )onto his bills as well. if we had a local company we wouldnt have that issue since they wouldnt have to spend alot of money on gas!

Will you please show up at the next HOA meeting and stand up and make yourself heard? I volunteered for this stupid Board Member position, and honestly feel like I have been met with nothing but hostility from residents, and resistance from Ogden.

I STRONGLY believe that our Landscaper should be ROC Licensed. But all I hear from Ogden is "Oh no, you're fine. It's not an issue." Im pretty sure ITS AN ISSUE! Reagan and I are the only two who are vocally challenging the property management company. To the point where we have been told to stop sending emails with questions in them since its "not getting us anywhere." I'm frustrated, and exhausted. I work my regular job for 50+ hours a week, try to take care of my home, spend time with my wife and kids, and chase down the HOA stuff. I feel like it's all for naught.

And when we do have a meeting, it's all "My neighbor this, my neighbor that." "Let me bend this rule." "Why can he do this?" I wish someone would stnad up and say "This landscaper issue bothers me as a resident, and I'd like something down about it."

Seriously, I will go to bat for us, but only if I know this is what people actualy give "hoot" about. So if you care about this, please post here, PM me, email me, or call me. And have your friends and neighbors do the same. That way, I can go in and say "Look Ogden, and Board, 55 residents here are not comfortable with Foley as our landscaper. Let's change that. Today!"

Please know that there are people that live here that are appreciative of yours and others efforts on the HOA board. It is, no doubt, a thankless job. We can't be at the June meeting, but we will be there if there is one planned for July. Never take time from your family for petty HOA stuff. In 20 years the HOA crap will be a distant memory, but a nice dinner with your family will be priceless. Misery loves company. Don't be home when misery knocks If we can do anything, email us.

Why are you even debating this? They are not licensed, give them notice. You can vote on the new licensed landscaper at a meeting. Hire H&N on an interim basis.

Alanf, there needs to be majority rule from the 5 HOA members at a meeting. Go to the next HOA meeting and you can ask each member individually what their take is and why.

Cyndi, thanks for asking if you can help - because you can. We need someone to beat the crap out of the kids that keep breaking the lights on the Senita sign and the kids that keep spray painting our neighborhood. If you can catch them, that would be great. There's also about 200 houses that need their front yards cleaned and about 250 houses that need their garbage cans or recycle cans put away out of sight. I would imagine there are about 150 cars that also need to be removed from the street and parked in their driveways. Lastly, if you can get the delinquent home owners to pay their $62/mo and fork over the full amount they owe in late fee's and violations, that would be AWESOME and I won't ever ask for another favor ever again.

Obviously I was kidding so thanks for being a good sport, but these are things that need to get accomplished by US as a COMMUNITY - collectively! If we all worked together, we could take a big dent out of the list I just wrote.

Tio, can it be put on the agenda for a point of discussion/vote. That way we don't have to worry about Ogden shutting it down and each board member (present) will have to give input. 

Something like: Senita HOA is discussing and voting on the request to hire a licensed(ROC) and Bonded Landcape Maintenance company to protect the communitie's residents, guests, and HOA assets from potential injury, damage, and/or liabilities.

Let me first say this. I don’t hold the board responsible for Ogden’s lack or business knowledge/skill. I know how Ogden is all to well… as I can’t even send emails anymore I have been blocked and the phone calls don’t come back. I think that is a big load of…stuff... I mean I am paying for your services and for what so you can ignore me? Graham your family is the most important thing in life as well. Never let it take a back seat to this HOA. As stated by Cindi those are the moments you will not get back. Tio I agree there is things we can do as a community but 10 vs 500 is hard odds to beat. I think there needs to be a vote on the landscapers ASAP. How can anyone get by without a license and proof of insurance? I am not sure and I am not sure what the law states but I think it is something as a whole we need to look into. Does anyone know someone who would be familiar with business laws locally? Lastly this whole “LIMITED TIME” garbage at the meetings needs to go! Let’s find somewhere we can meet later then. These meeting shouldn’t be Ogden giving us a update and then saying we have 5 min for questions then cutting everyone off. I am sure if you asked the school for more time they would give it to us. I think it is there cheap trick used to avoid the issue of dealing with the residents. Who mostly seem to be upset at this time or be the type to cause the problems and care less....

Foleyge Landscaping has insurance but not an ROC license. Foleyge doesn't legally need an ROC license to "maintain" the property(mow, edge, cut trees..), but they need a license if they want to do more than $1,000 worth of "other" work (replace plants, repair sprinklers, build walls, install boulders) in a YEAR at this location. You can call the Arizona ROC for further information and details.

So we rather pay another company a mobilization fee to come out and do those things since our company can't?! Seems like a waste of money right there. Tio I thank you for all the great info you provide. I still think we need a company that can be more of a jack of all trades since that will save us money (if done right) in the long run.
