which i could see as a good thing given the weeds/broken down, oil leaking cars/garbage cans, BUT....

I got a letter, a "courtesy notice" that one of the two coach lights on my garage were burned out, and I had 14 days to correct the violation.

well......my garage only has one light, and it has never been burned out.  but it also doesn't come on until about 8pm at night now. 

so are they really driving around after dark looking for this? 

what a waste of resources, if you ask me.

I agree- we have gotten two notices that our garbage can has been spotted (GASP!!) from the road and needs to be behind the fence or in the garage. I believe this was after I left it out on garbage day and brought it in when I got home at 9pm that same night. I wish they would spend the money that it costs to generate the letters and mail them out - to do something about the mosquitoes and horrible looking grass in the greenbelts! While I appreciate what they are trying to do (get us to conform) I think they have bigger issues to focus on than coach lights and garbabe cans. How about the trash at the splash pad? I have also heard that they are peeking over fences and looking in peoples back yards.

We just got a letter for parking overnight in the street! I guess there is someone riding around in the middle of the night looking for violations...I heard that our new HOA board (that's the people WE voted for) has a new member that is IN FAVOR of sending out violation letters. He has even been seen walking around looking for reasons to send out fines....(to make up for the loss of revenus not being received due to empty homes and such) We need to get this under control soon, or this new management company will be under the direction of an out of control board! The old management company was told not to send out letters until the problem was noticed more than once and not recitified. It seems these letters are going out at the first sign of any fragment of a violation. A few of my neighbors got letters too, and all for stupid stuff! We need to go to the meetings and voice our opinions.

What about the rule that was put into place for homeowners to request to use the ramadas and such for parties? I noticed a church group using the area by the fountains alot, and the management co/nor the board knew of this. I personally don't have any problem with it, but if they are going to enforce the rules, then the must enforce ALL rules........Special treatment? I think so!

I completely agree. We got a ding for a bush in our front yard that faces a green belt . It was within our property but they still want it cut a certain way. We grew it out a little more to block out the noise from skate boarders. I was upset because I take my son to the pool daily maybe even twice daily and it has been dirty more times than clean. Kudos to the HOA for getting a security guard, I am pleased about that. I do see a pool guy cleaning MWF but he waits until 10am when there are people like myself trying to wear their kids out before their nap, to clean it and doesn't vaccum weekly. Also, the tiles in the pool need to be scrubbed as well. I wish they would concentrate more on the park and pool area than the way bush is cut in my yard! I am all for reserving the picnic area for parties, I know not all the people that have parties there live in our community and it is shame for our community members to have to deal with that.

the greenbelt on my street is a wreck, every single sprinkler is broken. why is my supposed burned out light more important than fixing a major water wasting eyesore?

btw, i sent an email with pictures of my coach light and also left a message. whomever got to hear/read that this morning got quite an earful.

Balletlover, did you sign anything that says you have to cut those plants a certain way? If you didn't, I would leave it the way you want it....that's just BS! If you did, then I would look into weather or not that can hold up. Take a picture of the way you want it cut, and send ia letter to stating the reason you want it cut that way (privacy from the greenbelt) directly to the board, (not the management company) to review it. They will then have to vote on it at a meeting....I am pretty sure you will win your case....The Management company just enforces the code, the board decides on the code. And when we have more homes actually "owned" the board will have the power to CHANGE the code, and I heard that they will get rid of a few stupid rules! Like overnight parking on the street and such, but, they need us to complain in writing and attend the meetings to get on the agenda!!!

Me too. I thought they were held on a Wednesday night...I will find out and post it. I have been trying to get a community meeting together one night somewhere to discuss some of these issues, and maybe come up with some solutions together to bring to the board meeting in an organized way...and also maybe to see what we can do as a community to keep CF as a place where people will WANT to live. Any thoughts? I would like to first get the main entranceways looking the absolute best! What's growing in the flower beds now? Looks like weeds! We need to get some real buyers in here....keep the property taxes rolling in to the Copa and the HOA dues comming in!!

I had left a message and sent an email about the bogus burned out light letter. I got a voice mail back, pretty lame, saying I could call back to "discuss why the board has decided to recognize the coach light violations."

Okay. Whatever.

My point is that MY BULB WASN'T BURNED OUT. NEVER HAS BEEN. The letter was a huge waste of resources. If my bulb was burned out and i failed to notice, thanks for the reminder, i'll check it out. But there was no burned out bulb. no violation.

no violation + letter sent = waste of time and money

They are totally missing the point here!

It sounds as if the VM you left for the mgmt co was misunderstood; not "why is a burned out bulb a violation," but rather "my bulb is not burned out." From past experience with any HOA, if you call them up and respectfully alert them to the mistake they are usually reasonable. If you call up ranting and raving at them, prepare to be met with difficulty. Remember the saying about catching more bees with honey?

At our last house we used to get nailed for the garbage can being left out after pick-up, except it wasn't our trash can (after the first notice anyway ). While the tone of the notices immediately ticked us off, we tried not to take it personally. Human error occurs and as long as the HOA was willing to remove the erroneous violation from our records, we were happy.

If the "HOA Cops" are taking notes and pictures of the violations, I think that is great. No one can argue with a picture. Please note also, that if you are receiving notices, you're probably not alone and it does not mean that the HOA is not working towards correcting public area deficiencies as well as other neighbor's violations. Maybe it would behoove the residents to take pictures of the public areas and send them in too, respectfully of course.

Why is this a problem to nip something in the bud? If the violations noted were not in accordance with the CC&R's or incorrectly attributed to you, respectfully notify the HOA/Mgmt Co of the mistake so that they can be removed from your file. If they are legit violations, correct them or discuss your options (again respectfully) with the HOA/Mgmt Co and move on.

They can't just pick and choose which articles from the CC&R's they want to enforce. As silly as they may seem to us, there is a reason why each "rule" is there. I thought it ridiculous, too, when we received notices that our patio furniture on the front porch and our play structure were in violation because we hadn't requested approval first. I thought it an egregious waste of resources as well, but after I calmed down, I realized it was a good thing since it would eliminate people from putting ratty looking stuff on their front porch or an abominable play structure next to my wall. I thought it unfair when we received notices about the backyard landscape materials we had to store in the front, especially after we'd notified them beforehand there was no way around it, BUT it isn't really fair for our neighbors to have to look at all that junk for 2 weeks either is it?

Unless "I received a letter saying I have a burned out bulb, when in fact I do not" can be misunderstood.  If they want to send out letters for legitimate violations, such as burned out bulbs, fine.  But my point is, don't send out a letter if there is no violation.  I didn't/don't have a burned out bulb therefore I have no violation, and I should not have received a letter.  I did provide my own photo proof as to my properly working bulb with a time and date stamp.

I don't doubt your message was straightforward and clear. It's also possible that the person listening to your message has been inundated with peeved residents and wasn't in the mood for another tirade so s/he passed you off. I don't envy them the week violation notices go out.  With that said, people are not infallible, even the HOA.  Everybody makes mistakes once in awhile. What will be most telling is how quickly and painlessly they remove the violation from your file. Hopefully, it will be taken care of to your satisfaction. Good luck and try not to let their mistake get under your skin too much.
