I can't believe that I actually have to fight with the stupid HOA because of one of my cars is parked in the street. I live on W. Granite Dr. and would like to know if anyone else has to deal with this? They are trying to tell me that there are no cars allowed to be parked in the street per HOA rules. Is that crazy or what! If this is actually happening all around Cobblestone, then I highly recommend that if anyone reads this, that is thinking of moving into this sub, not too!

WOW! I have been trying to get my neighbor fined for parking all over the street and the HOA tells me that "it's not their jurisdiction" and to call the police! The obviously don't know which story to tell!
BTW, this guy has 4 roommates, all of whom have girlfriends that frequently stay overnight. Cars are parked everywhere, usually blocking my driveway!

Technically the HOA can't do anything about you parking on the street as it is a public street. The cops are the ones that have to enforce the parking rules. You should be able to fight the ticket if it isn’t from the Maricopa PD or the Sheriffs. I know this happened in other communities and it basically came down to the HOA can make all the rules they want about the streets but they can't enforce them.

Unfortunately the HOA can enforce whatever rules are stated in your governing documents.  For example our states no overnight parking so they can give us a violation if we park overnight.   Sometimes it really does suck but if you notify the HOA before a guest comes then if someone complains then they'll let them know that they are aware and have advise the HOA of it.

It works good when there is a car broken down, not running and an eye sore for a period of time.

You can also contact Brian Duncan and he'll help out with cars that shouldn't be there.

They can and apparently do enforce them. They can't tow your car obviously, but there is no law prohibiting them and you from entering into a contract that says that you may not park on the street. It isn't a ticket, it's a fine from the HOA and it could turn into a lein just like any other fine if you don't pay it.

It can turn into not only a lien but can also be turned into a personal judgment against the homeowner that can result in wage garnishments if left unpaid.  It just depends on what route the HOA's takes action. 

More and more HOA's are taking the lien and turning them into personal judgments due to the rate of foreclosures.

there has been a car across the street for 2 months with a flat tire. No cops have come... and I don't think the HOA is doing anything about it. The owner is trying to rent his house out anyway.

The car is a Sweet black Lexus with nice 20' on it too..

Just doing it one day at a time. Change is good and it should be looked upon as an improvment! not a problem.

So what happens if the HOA gives a "ticket" to a car parked in front of your house that doesn't belong to you or anyone you know? How can they put a lien on your house for that?

no the hoa will send a letter to the house it's parked in front of.
this happened to us, somehow.
my elderly neighbor parked his RV in front of his house (which is across from mine, not even next door). I got a letter from the HOA about "my" RV being parked, yadda yadda.
I called and said that it was not my RV, and gave them the address of the owner. Simple.

the liens come when you are continually sent letters of violation and don't correct the problem they start fining you, and if you don't pay, then they start the liens.

so, let's say you have too many roomates and one parks on the street in front of my house all the time. I complain to the hoa. they send you a letter to stop parking there. you keep parking there. they say "one more time and you get a fine" you keep doing it. they fine you. you refuse to pay out of protest/being poor/whatever. they put a lien on your house for what you owe them, so when you sell next year, they get their money.

Unless the HOA has changed their perspective from the last time this was brought up, parking on the street is a city problem, enforced by the city here in Cobblestone. They, the HOA, only want our money here. They obviously don't care too much about anything else, unless we all e mail the livin' crap out of them. Maybe in RED or much more mature neighborhoods do you see control.

I got a letter from them about my trailer in my driveway. I have been doing repairs on it and they told me it has to be out of site on the side of the house. I was outside working on the trailer when the guy drove by and was writting down my address. He didn't even roll down his window and ask me how long it was gonna be there. They can pound sand!!! I wrote them a letter and told them I would pay the fine when all of our grass in our common areas looked like Rancho. He must have missed all the grass in our subdivision.

we got a letter about working on a car in our driveway. Apparently hubby was working on the car at the time the neighborhood was inspected. It was a one day, oil change project. Well, the letter we got said that "non-functional vehicles" could not be in the driveway, up on jack stands.
Once I explained to the lady that it was a one day thing, a few hours at best, and not a long term "car up on jack stands in my driveway" thing, she said she would remove the letter from our file.
Had the "inspector" asked hubby, who was under the car at the time, what the situation was, it would have saved time and money on the part of the HOA.

How did you get ahold of the H.O.A.?  We have e mailed and called them for a few long months on matters not concerning this thread, to no avail.  So working on a car in the driveway is a no-no?

i can't find the number off hand, i'll look for it.

i think working on it is okay, but leaving it up on jack stands is a no-no. but since the "inspector" didn't take the time to ask, or wait to see if the car was still there on the next inspection day, we got a letter. stupids
