So, I just looked at the Acacia Crossings HOA website and noticed this gem

1. All Resident/Owner vehicles must have a Arizona Parking Solutions permit clearly displayed at all times in the lower driver’s side windshield.
2. Visitors must park in in the driveway or garage of an Owner/Resident.
3. Residents are not allowed to park on the streets at any time.
4. No parking is allowed in the designated fire lanes.
5. No recreational type vehicles, such as a truck, mobile home, bus, travel trailer, tent trailer, trailer, camper shell, detached camper, recreational vehicle, boat, boat trailer, or other similar equipment or vehicle may be parked, maintained, constructed, reconstructed or repaired on any part of the Community, except in the event Approval has been granted by the Board of Directors.

Vehicles that are in violation of any of these guidelines are subject to being immobilized. The fee for having the “boot” removed will be $90.00 and must be paid directly to Arizona Parking Solutions before the “boot” will be removed. Contact Arizona Parking Solutions Monday through Friday from 8:00 a.m. to 6:00 p.m. at 480 835-1330 or at www.arizonaparking.com.

Anyone else think that this is a little overboard?

Hmm hadn't heard of the sticker thing before, or that visitors had to park in the driveway/garage. the 'boot' thing is new but the parking monitor service is not. I know there is no over night parking on the street and number 5 is accurate. Interesting.

I think more homeowners need to get involved and I think the board needs to stop implementing changes without discussion with homeowners.

Well, AC is not listed with Arizona Parking Solutions. I've sent off a couple of emails for clarification.

I don't care if they are mailing stickers out it's not going on my vehicles. Ok I do care because that means we paid for it, but they are still not going on my cars. First of all that's not what I signed on for and second where is the homeowner input? I am so tired of them saying well we are the board and we are suppose to make decisions for the betterment of the community. Well, why don't we talk to the community and find out what the community finds is better. I know they read here and this is nothing they haven't heard from me before.

Yeah, I'm pretty upset that this (and the landscape thing) wasn't brought up at the last meeting. Seems like they knew that this would be unpopular and decided that it would be better to inform residents through the mail and website so that we would have little recourse to complain to the board until the next meeting which is almost 2 months from now.

I don't want to register my vehicles with some company just so that I can park on my own property. Also, the the CC&Rs allow for parking in the street so long as we do not park overnight. I don't see how they can just change it to absolutely no parking on the street. I think that everybody has times where they or their visitors need to park on the street for a number of reasons. As long as it is not for an extended period of time, then I don't see why anyone should get all upset.

If anyone on the board reads this, here is my suggestion: Start/keep enforcing the rules that we all signed at the beginning, and quit this business of making new rules for everyone without getting the community's opinion!

I suggest you check with the Maricopa Police Department first, since they have jurisdiction over the streets in Acacia Crossings. The builder or developer turned over the streets to the City of Maricopa when the development was completed, and they have jurisdiction over the streets. Any parking or speed limit signs have to be put up by the City of Maricopa, and so far they are doing anything in that direction. If any of that has changed, it would have to be done through the City of Maricopa and/or the Maricopa Police Department. As far as I know, Arizona Parking Solutions can put an parking information notice under the windshield wipers of your car, but any further enforcement or action must be done by the City or Maricopa and or the Maricopa Police Department.

If a car can be towed/impounded for a lien/repro why can it not be towed/impounded for an HOA Breach of Agreement/Contract?

Because of the possibility of a law suit, and also, the order for any parking infringements must come from the City, and not from the HOA, who do not own the streets.

Repro companies don't own the street either do they.

I wasn't aware we were talking about repossession of cars, which the lein holder has a right to repossess, but enforcement of parking regulations, a different matter. I suggest you contact Maricopa Police Department for clarification.

This is not a gated community, wherein the HOA does control the streets, and the HOA does not own the streets in Acacia Crossings.

Copied from the APS website:

Q. Why do I need to register my information with Arizona Parking Solutions?
A. APS has been contracted by the property to regulate and control the parking environment. Registration allows APS to identify your vehicle as a resident vehicle and provides contact information to the property manager and APS. Registering your information also allows you to call and report parking problems to APS so we can respond on your behalf.

****Contracted by the property/HOA. Who decided this?? How much more is this going to cost the residents?? I assume that this was done because the parking rules were NOT followed. I have seen many, many of the fliers put on vehicles but what, if any consequences were there??

Q. Who determines the enforcement for my property?
A. Arizona Parking Solutions simply executes the enforcement guidelines for the property that are established by the management team or the homeowners association. We do not create the rules or the enforcement guidelines, we simply follow the instructions that we are given. Every property owner has the right to enforce the parking rules as they see fit.

****That last sentence makes no sense. "Each property owner has the right to enforce the parking rules as they see fit." Are homeowners the property owners or is the HOA?? Sounds to me, like it's the HOA and not me. Baloney.

And if the overnight parking issue is such an issue and the city "owns" the streets, then it should be up to local law enforcement to enforce any overnight parking laws........if it is a law.

Ok got the skinny on this from our board prez. This posting on our community web site was an error by AAM. We do use APS to enforce the CC&R rules that we already have but there are not additions. This should not have been posted. Board prez is working on getting a hold of AAM and having this corrected.

Wow I am really pissed. I only rent here but I will be damned if I am doing to have to place a sticker on my car to park in the drive way I pay for. This is yet another reason I have decided to move back east. I cna not wait for my lease to be up so I can get out of here.

Oh yea I love the fact that I amexpected to keep replanting plants that die because it is 110 degrees out. Lets use common sence and wait till the heat dies down a bit to force people to replace them. I mean seriously my front yard is clean free of weeds and I removed the dead plants so why keep harping on it.

I really think my dad had it right when he visited. He thinks that the person who is reporting all the violations for the association needs to get a much better sex life and lay off of us.

My dad was doing yard work and had the trash can out when we first moved in and they actually had the nerve to take pics of us and report us to our landlord stating that we had the garbage can out on an unapproved day. They failed to mention that we were busting our ass cleaning up the yard that was left a mess for us when we moved in.

AHHHHHH East coast here I come!!!!!!!!!!!!!!!

Well, that's good that it was just a mistake. However, after the landscape thing got sent out about having to approve backyards, I wasn't going to put anything past this board.

Thanks, Java, for asking about this.

jmel ~ did you see that it was a mistake? You are not going to be 'required' to do the sticker thing.

parnette ~ No problem.

Not only not will we be not required to do the "sticker" thing, but no "boot" and "$90.00" fine as well! There is just one word that describes this board, and that is "inept" These streets belong to the City, and the City will not put up any "NO Parking" signs, and will not put up any speed limit signs, either. Talk about trying to justify their (the board's) existence, HA! Wonder what kind of "hair brained" scheme they will come up with next.

I just got the letter for the next meeting in October and I saw there are several spots open on the board. Maybe instead of complaining on a forum how "inept" the board is you can all get proactive and out from behind your monitors and run for a spot on the board.

I refuse to vote for any member of the CFR
